There is a new BBQ restaurant prior to slowing down for speed trap in Woodworth going south. It’s called Russell’s BBQ and has been open two weeks. Whitney/Hancock closing branches
The CEO of Hancock Holding Co., the parent company of Whitney Bank, said today between 40 and 45 branches will be closed within its five-state footprint by the end of the year.
 
Hancock President and CEO Carl Chaney announced the closures during a presentation at the Gulf South Bank Conference, which is being held this week at the Ritz-Carlton Hotel in New Orleans. Chaney declined to name the specific markets where the closures will occur as the company is still notifying employees of the plans, but said the closures will have “little impact” on its core New Orleans and Mississippi Gulf Coast markets.

Absorption Rates and Inventory Situation:
 
We reported last week that Aprils absorption rate was 6.97 for local MLS lets compare to the following regions:
 
3 months in Dallas, Phoenix, Seattle, and Detroit
 
11 months in Long Island
 
Why might inventory be down and different markets nationwide? Different price ranges, and different sub markets.
 
2006 buyers are not sellers even in recovering market.
 
Investors are paying cash, I do know of a local investment group that just purchased 14 homes all cash.
Increasing rental rate
 
Lenders are foreclosing less, hence fewer REO on market last 10 weeks locally less than 5% of total market sales
 
Biggest factor is low interest rates both on home loans and certificate of deposits.
 
Post 2006 Central La. witness fewer Realtors, fewer sales, more negotiation off asking price, slight increase in foreclosed properties, but not crash like Detroit, Phoenix, Las Vegas. When you see national headlines such as “9.3% jump in home prices from  February 2012 compared to February 2013 and even double digit price increases you are looking at those markets that were in a bubble, then crash, and now 9% to 10% increases. When the bar is so low it is easier to jump over it.
  
Case Shiller index of 20 National Markets 100% posted year over year gains. Last time this happen was in 2005 the year prior to bubble pop. Median home price was $184,300 and well below peak of $230,400 in 2006 but up from $154,600 in January 2012.

The commercial real estate job market showed significant improvement in 2012 with job postings up 27 percent over 2011, according to the Cornell University/Select Leaders Job Barometer. Momentum continued in the new year with an explosion of job postings in January — more than any other month in the past four years, according to Susan Phillips, CEO of Select Leaders. “Until 2012, development and construction jobs were almost negligible. As our industry continues to recover in 2013, we anticipate job growth, because companies have been functioning so lean, they almost have no choice but to hire,” Phillips said. Seller-Funded Buyer Brokerage Fees

New Regulation Proposed

Under a new rule proposed by the Louisiana Real Estate Commission, sellers cannot pay buyer brokerage fees out of closing costs, unless there is a written agreement, which must specify the amount to be paid by seller.  This proposed rule was approved by the LREC on April 18, 2013, although it will not go into effect until it goes through the formal rulemaking process.  This means the rule would have an effective date of September 20, 2013 at the earliest.  The actual text of the proposed rule is as follows:

Buyer broker compensation shall not be included as part of closing costs paid by the sellers, unless such compensation is disclosed in a written offer and accepted by the seller, which specifically states the amount of compensation being paid to the licensee.

This new rule applies only in cases where there is a buyer brokerage agreement that obligates buyer to pay a commission to his/her broker.  If the buyer with this obligation wants the seller to pay all or part of this commission, the seller must agree to do so in writing, as part of the purchase agreement, with the amount to be paid by seller included in the agreement.

Why Was This Rule Proposed?

This rule was developed in response to complaints from consumers and licensees.  These complaints involved transactions in which the seller and seller’s agent were surprised at the closing table to learn that buyer expected the buyer brokerage fee to be paid as a seller-funded closing cost.  Typically, these complaints involved purchase agreements that provided that “Seller will pay (up to) $X,000.00 in closing costs on behalf of buyer.”  In these agreements, there was no definition of “closing costs” that specified that a buyer’s brokerage fee was included.

Some licensees argued that existing rules prohibited this practice.  The relevant provisions of license law provide:

§1455. Causes for censure, suspension, or revocation of license, registration, or certification.

Block Buster update on Jackson Street. A South Carolina company has 28 stores under contract and is offering to lease part or all of the stores and also packaging as two to three store deal. The local store is being offered with store in Lake Charles at $1,350,000.

I have long thought that decrease and increase of licensees was directly correlated with the strength and weakness of real estate business. The 7 year continued decline in number of people with real estate license in La. might trend upward this year, just might. Now I need to determine what that means to real estate business in my market.

 

Another trend indicator is to look at sales of largest company in La. Latter & Blum and listen when CEO Bob Merrick says 2012 was best year company has had since 2006 and first quarter 2013 was best quarter in long, long time for commercial department.

 

Talked several weeks back about Parish buying 35 acres on the Red River and asked our audience if anyone knew what this sale involved. Listener called and said that was land for firing range purchased from Brasher family.

 

Burlington Coat Factory store is on the market with sale and lease back deal. Asking price is $4,000,000 the owner just increased the rent to create a higher yield. This is concept of market rent vs. contract rent. If long term quality of rent holds up then yield will work out as advertised.
